Mike Phelan, who retired as General Manager of the Rio Linda/Elverta Community Water District (RLECWD) in 2001, has  filed a petition in Superior Court asking the Court to force RLECWD to reinstate his health benefits. Phelan, who has been receiving health benefits from the California Public Employee Retirement System (PERS) as agreed by the RLECWD Board of Directors when he retired, will lose those PERS benefits on December 31, 2005, as a result of a RLECWD Board Resolution adopted in July 2005.

Phelan's Petition for Writ of Mandate claims the RLECWD's action violates state and federal law and contravenes RLECWD's contract obligation to Phelan and other retirees. The petition, besides asking for repeal of the Resolution, also seeks an award of attorney fees.

Rhonda Canby, Phelan's attorney, said on October 18th, "Unless we hear from the District today that it will pay the full cost of retiree health benefits, we will be filing the papers to support our position at the December hearing." Canby is with the Downey Brand LLP law firm.

Phelan said, "It appears we are headed to Court on December ninth".

Two years ago, during a RLECWD Board meeting on October 23, 2003, Director Mary Harris, attempting to reduce Phelan's benefits, referred to a potential legal claim by Phelan. Harris said, "Let's let that lawsuit happen..." Harris, later at that meeting, said to the Board, "So let's make a loud statement to Mr. Mike Phelan. If he sues us, please encourage him to sue us..."

Harris may get her wish.

Community Council to hold first meeting Oct. 26th

The newly appointed Rio Linda-Elverta Community Council will hold its inaugural meeting Wednesday, October 26, 2005, 7:00 PM, at the Depot Visitor Center, 6730 Front Street, Rio Linda.

The members of the Council, nominated by First District Sacramento County Supervisor Roger Dickinson, are Jeff Bair, Bob Bastian, Mary Harris, Norma-Lee, and Hal Morris. The appointments were formalized by the Board of Supervisors on September 14th.

The new Council will replace the present Community Planning Advisory Council (CPAC) and will gain some additional final approval authority. The new Council will be paid to attend meetings, unlike the entirely volunteer CPAC. The Council is a County two-year pilot project.

The NEWS thanks Sandy Burnett, Assistant Clerk to the Board of Supervisors for her effort to assure timely publication of the following agenda. The NEWS will publish future Community Council agenda items as it has in the past for CPAC meetings.

The agenda items are as follows:
1. Adoption of Chairman and Vice-Chairman

2. Adoption of the Rules of Conduct

3. 05-PMB-0007 (RIO LINDA/BOSCHEE)

TENTATIVE PARCEL MAP (Final approval is by the Board of Supervisors)

BRICK AND ANGELINA MESMAN - Applicant: HRMCO - Surveyor: Burgess Land Surveys - Assessor's Parcel No. 215-0171-005, located on the east side of 24th Street. approximately 800 feet south of "E" Street, in the Rio Linda-Elverta community.

CPAC RECOMMENDATION: CPAC recommends approval.

ENVIRONMENTAL DOCUMENT: Negative Declaration

REQUEST: A Tentative Parcel Map to divide approximately 10 acres into 4 lots in the AR-2 (Agricultural-Residential) zone.

An Exception to Title 22.110.070(e) of the Land Development Ordinance to allow the depth of the lots to exceed three times the lot width.
Note: This project is inconsistent with the Comprehensive Land Use Plan (CLUP) for McClellan Air Force Base.  The project does not meet the "infill" requirements that are outlined within the Noise Element of the general plan.  Approval of this project by the Board of Supervisors shall require a 4/5 majority vote.
